VU22975 - Analyse and apply civil procedure

Assessment tasks will be designed to reinforce and extend knowledge and skill competence within set and controlled parameters in accordance with each unit's learning outcomes and performance criteria requirements, including the setting of work based practical application tasks designed to provide evidence of competence outcomes, within periodic and scheduled timelines. Students will be expected to demonstrate the following required skills: - communication skills to discuss and document findings - analytical skills to: - determine and respond to the civil jurisdiction, structure, procedure and operation of the courts in Victoria - determine appropriate procedures and processes for each possible and probable stage of litigation Students will also be expected to demonstrate the following knowledge: - relevant legislative and statutory requirements, regulations and provisions pertaining to civil procedure - aspects of civil procedure, including: structure and jurisdiction of the Federal Court - structure and jurisdiction of Civil Courts in Victoria - rules of procedure - conduct of Supreme, County and Magistrates' Court civil actions - nature, function and form of pleadings, particulars and third-party procedures - interlocutory procedures in defended actions - enforcement of judgments, orders and costs - alternative dispute resolution including collaborative law
