Assessment
Assessment tasks will be designed to reinforce and extend knowledge and skill competence within set and controlled parameters in accordance with each unit's learning outcomes and performance criteria requirements, including the setting of work based practical application tasks designed to provide evidence of competence outcomes, within periodic and scheduled timelines.
Students will be expected to demonstrate the following required skills:
- communication skills to work, discuss and draft simple documents on instruction from legal personnel
- research and analytical skills to:
- identify key features of contract law
- identify and apply contract principles
- identify and apply contract terms
- identify and apply legal principles relating to contracts
Students will also be expected to demonstrate the following knowledge:
- relevant legislative and statutory requirements and provisions pertaining to contracts, including reference to the Australian Consumer Law (Competition and Consumer Act 2010 (Cth))
- the terms, nature and conditions of contracts, including:
- agreement
- intention to create legal relations
- consideration and estoppel
- terms and types of contracts
- capacity to contract
- consent
- illegal or void contracts
- privacy of contract and assignment of contract
- discharge of contract
- remedies for breach of contract
- legal, ethical and technological principles and processes
